Limitation of Liability

Platform Availability

Account Suspension & Closure
38ok reserves the right to suspend or close any player account under the circumstances described below. Players also have the right to request voluntary account closure at any time.
Suspension by 38ok
38ok may suspend a player account immediately and without prior notice in any of the following circumstances: (a) reasonable suspicion of fraudulent activity, money laundering, or identity fraud; (b) failure to complete KYC verification within the required timeframe; (c) breach of any provision of these Terms & Conditions; (d) detection of duplicate accounts associated with the player; (e) security concerns including suspected unauthorised account access; or (f) any activity that 38ok reasonably determines poses a risk to the integrity of the platform or to other players.
During a suspension, the player's account balance is frozen but not forfeited unless an investigation concludes that the balance was generated through activity that breaches these terms. Players under investigation will be contacted via their registered email address and given a reasonable opportunity to respond before a final account closure decision is made.
Closure by 38ok
Where an investigation confirms a serious breach of these Terms & Conditions, 38ok may permanently close the account. In such cases, any balance generated through prohibited conduct (including bonus abuse winnings, fraudulently deposited funds, and proceeds of collusion) will be forfeited. Genuine deposited funds that cannot be attributed to prohibited conduct may be returned to the verified payment source at 38ok's discretion.
Voluntary Closure
You may request voluntary closure of your 38ok account at any time by contacting the support team via live chat or by using the account settings panel. Before processing voluntary closure, 38ok will confirm your identity, ensure there are no pending withdrawal requests, and settle any open bets at the time of the request. Any remaining verified balance in the account at the time of closure will be paid out to your last verified payment method within five business days of the closure being processed.
Self-Exclusion
Self-exclusion is a responsible gaming tool distinct from account closure.
